1. Scope
These Terms and Conditions apply to contracts with the sole proprietorship Daniel Schmid (UID CHE-104.379.176), trading as Snowboardschule Sägerei, for snowboard lessons, events, equipment rental, workshop and servicing work, and the purchase and delivery of goods.
Different terms apply only where expressly confirmed by us. Mandatory statutory rights, particularly consumer rights, remain unaffected.
2. Offer and conclusion of contract
Services and goods shown on the website invite customers to book or order while displayed as available. Before submitting a binding order, customers can review and correct services, participants, dates, prices and contact details.
These Terms are brought to the customer’s attention before a binding order is submitted. Where provided in the booking or order flow, the customer must expressly accept their application. The version valid when the contract is concluded can be saved and accessed on this website.
A contract is formed when we issue a booking or order confirmation. An automated receipt or payment confirmation initially confirms only receipt or payment authorisation. If an immediate payment is taken but the service cannot be confirmed, we refund the amount charged.
Specific details in an offer, booking flow or confirmation—such as dates, meeting points, group sizes or cancellation terms—take precedence over these Terms.
Online bookings are handled through Flowin, a service provided by Solved Development GmbH. Flowin provides the booking system; Daniel Schmid remains the contracting party for the booked service. Please contact us about the service, changes, cancellations and refunds.
3. Prices and payment
Prices shown at checkout are in Swiss francs. Included taxes and additional charges are displayed before the binding order. Lift passes, meals, travel and equipment are included only where expressly stated.
Accepted payment methods are shown at checkout. Online payments are processed technically through Wallee Group AG, Neuwiesenstrasse 15, 8400 Winterthur, Switzerland, and the payment service providers involved for the selected payment method. Wallee is not the contracting party for lessons, rentals, servicing, events or goods.
The charge is made according to the payment method and due date displayed at checkout. A booking or order is considered paid only once payment has been successfully authorised or confirmed. If payment is outstanding or declined, we may withhold the service or release the reservation.
Refunds due are generally initiated through the original payment method unless otherwise agreed or technically required. The time at which the credit appears also depends on Wallee, the selected payment method and the financial institution involved. A chargeback or payment dispute does not automatically terminate the underlying contract or any valid claim.
4. Lessons and participation
The booking person must register every participant correctly and provide accurate details about age, riding level, physical requirements and special needs. Minors must be registered by a parent, legal guardian or authorised person.
Participants must arrive on time at the confirmed meeting point with suitable clothing, functional equipment and any required lift pass. Late arrival does not extend the agreed lesson time.
Safety instructions from instructors must be followed. We may end participation in cases of substantial danger, unsuitable equipment, intoxication or repeated disruptive conduct. A refund is due only where appropriate in the circumstances or required by law.
5. Group lessons
Group lessons generally run Monday to Friday for the duration stated in the offer. Individual days, half-week and full-week courses may have different prices; the confirmed option applies.
If the stated minimum group size is not reached or riding levels do not fit, we may combine groups, reasonably adjust duration or format, offer an alternative or cancel. Services cancelled by us are refunded if not provided.
A particular instructor is guaranteed only if expressly confirmed.
6. Private lessons and specials
Private lessons follow the confirmed participant count, duration and goals. Family offers and other specials apply to the group and scope described. Changes to participant numbers must be reported before the start and may affect price or feasibility.
7. Customer cancellation
Bookings are binding. The cancellation deadline and charges displayed for the relevant service or during booking form part of the contract. Cancellations must be made in writing or through the designated booking function and take effect when received by us.
Where no special rule is stated, we charge only services already performed, unavoidable third-party costs and a reasonable loss to the extent that the slot cannot be reassigned. The full price may be payable for a no-show without notice.
Illness and accident do not automatically create a refund right. Statutory rights, expressly offered goodwill arrangements and any cancellation insurance remain reserved.
To cancel or request a refund, email snowboardschule@saegerei.ch with your name, booking reference, the service concerned and its date. We may request supporting documents where needed. We acknowledge processing and tell you whether a refund is due and its amount. Do not send us full card details.
8. Weather, lifts and cancellation by us
Snow sports generally take place in changing weather and snow conditions. Poor weather, limited visibility or individual lift closures alone do not permit free cancellation where the lesson can still be provided safely and reasonably.
We may adapt the programme, meeting point or area for safety, snow, operational or official reasons. If we cannot provide a service or an equivalent alternative, we refund the cancelled service. Further expenses such as travel, accommodation or lift passes are covered only where caused by our fault or required by mandatory law.
9. Rental
Rental equipment remains our property and may be used only by the registered person, for the agreed purpose and during the confirmed period. Transfer, sale or technical modification is prohibited.
Equipment must be checked on collection and visible defects reported immediately. We may provide a technically equivalent replacement if the reserved model is unavailable or unsuitable.
Equipment must be handled carefully and returned complete and on time. Extensions require our confirmation. Additional rental days and proven consequential costs may be charged for late returns.
10. Damage, loss and theft
Normal wear is included. Renters are liable under applicable law for culpable damage, misuse, loss or theft. We charge proper repair costs or, where repair is not economical, the equipment’s current value.
Loss or theft must be reported immediately; a police report may also be required for theft. Optional equipment insurance or a liability reduction applies only if expressly booked and confirmed.
11. Lessons with rental equipment
Where lessons are booked with eligible rental equipment, the displayed package discount may apply. The currently communicated discount is 30% on eligible daily rental. It applies only to confirmed participants and the related period, cannot be paid in cash and cannot be combined with other discounts unless stated otherwise.
12. Workshop and servicing
Service and repair work follows the confirmed order. If material extra work becomes apparent, we seek approval before incurring significant additional cost. Minor additional work necessary for the agreed function may be performed within customary industry limits.
Collection dates are estimates unless expressly confirmed as binding. After a reminder, reasonable storage charges may apply to uncollected equipment. Further statutory rights relating to permanently uncollected items remain reserved.
13. Goods, delivery and ownership
Delivery area, shipping charges and estimated delivery time are displayed before ordering. Partial deliveries are permitted if reasonable and without additional cost. Benefit and risk pass in accordance with applicable law.
Goods remain our property until fully paid where legally permissible. Product images may differ slightly in colour or appearance; expressly warranted characteristics remain binding.
14. Inspection, defects and returns
Goods should be checked promptly. Defects should be reported as soon as discovered with a description and proof of purchase. Mandatory warranty rights apply; where a choice is legally permitted, we may first remedy a defect by repair or replacement.
Purchases delivered in Switzerland have no general voluntary return or exchange right. A return is available where expressly promised for the product or individually agreed. Used, damaged, specially ordered, adapted or personalised goods may in particular be excluded.
Where mandatory foreign consumer law applies, especially to deliveries deliberately offered to consumers in the EU or EEA, its withdrawal and warranty rights take precedence.
15. Vouchers, events and promotions
Vouchers, events, competitions and limited promotions are additionally subject to the published offer terms. Vouchers are not redeemable for cash. Statutory limitation periods and mandatory rights remain reserved.
16. Insurance and liability
Snowboarding and winter sports involve risks. Participants and renters are responsible for their own accident, health, personal liability and cancellation insurance.
We are liable for damage caused intentionally or through gross negligence. For slight negligence involving an essential contractual duty, liability is limited to typically foreseeable loss. Liability for auxiliaries and indirect loss is limited to the extent permitted by law. Statutory provisions apply without limitation to personal injury and other mandatory liability.
17. Privacy
Information about personal data processing, booking and payment systems, and data subject rights is provided in our Privacy Notice.
18. Law and jurisdiction
Swiss law applies, excluding conflict-of-law rules and, where permissible, the UN Convention on Contracts for the International Sale of Goods. Mandatory protections at a consumer’s habitual residence remain reserved.
Where a jurisdiction agreement is permissible, the competent courts at the registered office of Snowboard School Sägerei have jurisdiction. Mandatory venues, particularly for consumers, remain unaffected.
If one provision is invalid, the remaining provisions continue to apply. The German version prevails; this English version is provided for ease of understanding.
